Terms & Conditions
The terms that govern your use of the Fixxr app and website, including how our marketplace connects you with independent repair shops.
Effective date: July 28, 2026
1. Acceptance of terms
These Terms & Conditions (“Terms”) form a binding agreement between you and Fixxr Technologies, Inc. (“Fixxr,” “we,” “us,” or “our”) governing your access to and use of the Fixxr mobile application and website at https://fixxr.repair (together, the “Services”). By creating an account, downloading the app, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, and have the legal capacity to enter into a binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements and that any vehicle or repair information you provide is accurate and that you have the right to submit it (for example, that you are the owner or an authorized user of the vehicle).
3. Account registration & security
To use certain features, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at contact@fixxr.repair if you suspect unauthorized use of your account. We may suspend or terminate accounts that provide false information or violate these Terms.
4. Text messages (SMS)
Fixxr uses text messages to confirm it is really you when you sign in. By entering your mobile number, you agree to receive an automated one-time verification code by text at that number. That code is how we confirm the number belongs to you, so agreeing to receive it is necessary to sign in by phone.
What we send. One-time verification codes, and service messages about a repair job you posted (for example, that a shop has sent you an offer). We do not send marketing or promotional texts to your number without your separate consent.
Frequency and cost. Message frequency varies with your activity. Message and data rates may apply, according to your plan with your mobile carrier.
How to stop. Reply STOP to any message to opt out; you will get one confirmation message and nothing after that. Because verification codes are how phone sign-in works, opting out means you will no longer be able to sign in by phone. Reply HELP for help, or email us at contact@fixxr.repair.
Delivery. Mobile carriers are not liable for delayed or undelivered messages, and supported carriers may change without notice.
Your number. You must be the subscriber of the mobile number you enter, or be authorized to use it. If your number changes or is reassigned, update it in your account so codes are not sent to someone else.
4. Marketplace role & relationship disclaimer
Fixxr is a technology platform and marketplace. Fixxr is not a repair shop, mechanic, or automotive service provider, and Fixxr does not perform, supervise, or guarantee any vehicle inspection, diagnostic, or repair service. The Services help you request quotes from, communicate with, and schedule work performed by independent, third-party repair shops (“Shops”). Shops are independent businesses that are not owned, operated, or controlled by Fixxr.
Fixxr is not a party to any repair agreement, estimate, or transaction between you and a Shop. Nothing in these Terms or in the Services creates an agency, joint venture, partnership, franchise, or employment relationship between Fixxr and any Shop. Shops are solely responsible for the quality, safety, legality, timeliness, and outcome of any diagnostic or repair work they perform, for their own pricing, licensing, insurance, and compliance with applicable law, and for any warranty they choose to offer on their work.
Fixxr is not liable for the quality, safety, or outcome of any repair or service performed by a Shop, for any dispute between you and a Shop, or for any damage, loss, injury, or delay arising from a Shop’s acts or omissions. Any concerns about workmanship, pricing disputes, or repair outcomes should be directed to the Shop that performed the work, subject to Fixxr’s good-faith efforts to help facilitate resolution where reasonably possible.
5. Quote-fairness & diagnostic tool disclaimer
The Services may provide estimated price ranges, a “fairness” assessment of a quote, or diagnostic suggestions based on information you provide (such as symptoms, codes, vehicle details, or photos) and aggregated market data. These outputs are informational and educational only. They are not a guarantee of price, availability, the cause of a vehicle issue, or the necessity or scope of any repair, and they do not constitute professional automotive, mechanical, or engineering advice. Actual diagnosis requires in-person inspection by a qualified technician, and actual repair scope, parts, labor time, and final pricing are determined solely by the independent Shop performing the work, not by Fixxr.
You should independently evaluate any quote, diagnostic suggestion, or fairness assessment before authorizing repair work, and you remain responsible for deciding whether to proceed with any Shop or repair. Fixxr disclaims liability for decisions made in reliance on estimates, fairness assessments, or diagnostic suggestions provided through the Services.
7. Acceptable use
You agree not to:
- Use the Services for any unlawful purpose or in violation of these Terms;
- Provide false vehicle, identity, or payment information;
- Interfere with, disrupt, or attempt to gain unauthorized access to the Services or related systems;
- Scrape, harvest, or misuse data from the Services, including Shop or user information;
- Post content that is fraudulent, defamatory, harassing, or infringes another’s rights; or
- Use the Services to solicit business outside the platform in a manner that violates a separate Shop agreement.
We may investigate and take appropriate action, including suspending or terminating accounts, for violations of this section.
8. User content & reviews
You may be able to submit reviews, ratings, photos, or other content (“User Content”) through the Services. You retain ownership of your User Content, but you grant Fixxr a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, and distribute it in connection with operating and promoting the Services. You represent that your User Content is accurate, based on your genuine experience, and does not violate any law or third-party right. We may remove User Content that violates these Terms or that we determine, in our discretion, is inappropriate.
8. Repair-shop & business-user terms
If you use the Services as a repair shop or other business user (“Business User”), you additionally represent that you hold all licenses, permits, insurance, and certifications required by law to perform automotive repair services in your jurisdiction, and that you will honor quotes and commitments you make to drivers through the Services in accordance with applicable consumer-protection law. Fixxr does not guarantee any specific volume of leads, bookings, revenue, or earnings to Business Users, and any performance figures, projections, or testimonials shown in our marketing materials are illustrative, not a promise of results. Additional terms specific to Business Users may be set out in a separate Shop agreement, which controls in the event of a conflict with these Terms as applied to Business Users.
10. Intellectual property
The Services, including their design, text, graphics, logos, and underlying software, are owned by Fixxr or our licensors and are protected by intellectual property laws. Except for the limited license to use the Services as intended, nothing in these Terms grants you any right, title, or interest in Fixxr’s intellectual property. “Fixxr” and our logos are trademarks of Fixxr Technologies, Inc. and may not be used without our prior written consent.
11. Payments & fees
Certain features of the Services may involve fees, such as a platform or service fee charged in connection with a booking, or charges from a Shop for repair work. Where Fixxr displays pricing, we aim to show all-in pricing inclusive of any Fixxr platform fees known at the time of quote, with any shop-specific taxes, disposal fees, or parts costs itemized by the Shop. Payments are processed by third-party payment processors, and your use of payment features is also subject to their terms. All fees are non-refundable except as required by law or as expressly stated at the time of purchase.
12. Disclaimer of warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Fixxr does not warrant that the Services will be uninterrupted, error-free, or secure, that any diagnostic suggestion or quote-fairness assessment will be accurate, or that any Shop will meet your expectations. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
12. Limitation of liability & indemnification
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIXXR AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES OR ANY REPAIR PERFORMED BY A SHOP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Fixxr’s total liability for any claim arising out of or relating to the Services will not exceed the greater of (a) the amount of platform fees you paid to Fixxr in the twelve (12) months preceding the claim, or (b) $100.
You agree to indemnify and hold harmless Fixxr from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your violation of these Terms, your interactions with a Shop, or your violation of any law or third-party right.
13. Arbitration & class-action waiver
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court. Except for disputes that qualify for small-claims court or that seek injunctive relief for intellectual-property infringement, you and Fixxr agree that any dispute arising out of or relating to these Terms or the Services will be resolved through binding, individual arbitration administered by the American Arbitration Association (AAA) under its applicable rules, rather than in court, except that either party may bring an individual action in small claims court.
You and Fixxr each waive the right to a jury trial and the right to participate in a class action, class arbitration, or representative action. All disputes must be brought in an individual capacity, not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. You may opt out of this arbitration agreement by sending written notice to contact@fixxr.repair within 30 days of first accepting these Terms.
15. Governing law & venue
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles, except as preempted by the Federal Arbitration Act with respect to Section 13. Subject to Section 13, any action not subject to arbitration will be brought exclusively in the state or federal courts located in Mecklenburg County, North Carolina, and you consent to personal jurisdiction there.
16. App Store & Google Play terms
If you download the Fixxr app from the Apple App Store, you acknowledge that these Terms are between you and Fixxr only, not Apple, and Apple has no obligation to furnish any maintenance or support for the app. In the event of any failure of the app to conform to an applicable warranty, you may notify Apple, and Apple will refund any applicable purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the app, including product-liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims arising under consumer protection law. Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the app infringes intellectual property rights. Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.
If you download the app from the Google Play Store, your use is also subject to Google Play’s Developer Distribution Agreement and applicable Google Play Terms of Service, and you agree to comply with Google Play’s usage rules in addition to these Terms. Nothing in this section limits any rights Apple or Google are required to provide to you under applicable law.
17. Termination
You may stop using the Services and delete your account at any time. We may suspend or terminate your access to the Services, in whole or in part, at any time, with or without notice, if we believe you have violated these Terms, pose a risk to Fixxr or other users, or for any other reason consistent with applicable law. Sections that by their nature should survive termination (including Sections 4, 5, 9, 11, 12, 13, and 14) will survive.
17. Modifications to these terms
We may modify these Terms from time to time. If we make material changes, we will provide notice through the Services or by other reasonable means before the change takes effect. Continued use of the Services after a change becomes effective constitutes acceptance of the revised Terms.
19. Third-party links
The Services may contain links to third-party websites or services, including Shop websites, that are not owned or controlled by Fixxr. We are not responsible for the content, policies, or practices of any third-party site or service.
